Terms and Conditions of Sale

1. Definitions

In these terms:

  • "Company" refers to Your Pool Chemicals.

  • "Customer" refers to any individual or organisation placing an order with the Company.

  • "Goods" refers to any pool chemicals, products, or materials supplied by the Company.

  • "Services" refers to any services provided by the Company.

  • "Contract" means the agreement between the Company and the Customer for the sale of Goods or Services.

2. Quotations

2.1 All quotations are valid for 24 hours only, unless otherwise agreed in writing.
2.2 Quotations do not constitute a binding offer and may be withdrawn or amended at any time before acceptance.

3. Formation of Contract

3.1 A contract is formed once payment has been received in full and the Company confirms the order.
3.2 These Terms and Conditions shall apply to the exclusion of any other terms the Customer seeks to impose or incorporate.
3.3 No variation or amendment shall be valid unless agreed in writing by both parties.

4. Prices

4.1 All prices include VAT unless otherwise stated.
4.2 Prices are subject to change due to variations in raw materials, labour, fuel, packaging, or delivery costs.
4.3 Prices are confirmed at the time of order and payment.

5. Payment Terms

5.1 Payment is required in full prior to placing the order.
5.2 Orders will not be processed or dispatched until full payment is confirmed.
5.3 The Company reserves the right to charge interest on overdue amounts and recover any legal costs in the event of non-payment.

6. Title and Risk

6.1 Title to the Goods remains with the Company until full payment is received.
6.2 Risk in the Goods passes to the Customer upon delivery.
6.3 Until full payment is made, the Company may repossess Goods and the Customer must store them separately, clearly identifying them as Company property.

7. Delivery

7.1 Goods are delivered when they are handed to the Customer, their representative, or carrier.
7.2 Any delivery dates given are estimates only and are not guaranteed.
7.3 The Company may deliver the order in instalments.
7.4 Failure by the Customer to accept delivery may result in additional storage and redelivery charges.

8. Claims and Faults

8.1 The Customer must notify the Company of any missing, incorrect, or damaged Goods on the same day as delivery.
8.2 Non-obvious faults or defects must be reported within 24 hours of delivery.
8.3 Claims must be made by completing the damage form on our website at: https://www.yourpoolchemicals.com and must include:

  • Order reference

  • Full details of the issue

  • Photographic evidence of the damage, defect, or incorrect item(s)
    8.4 We do not accept returns after purchase. We will only collect and replace goods damaged on delivery, but proof must be provided.
    8.5 Claims submitted outside of these time frames or without sufficient evidence will not be accepted.

9. Cancellations

9.1 Once payment has been made, the order cannot be cancelled or amended.
9.2 The Company does not accept returns unless Goods are proven to be faulty or incorrectly supplied.
9.3 No refunds are provided. Any replacement or credit is at the sole discretion of the Company.

10. Liability

10.1 The Company's liability for defective Goods is limited to replacement of the defective item(s) only. No refunds are provided.
10.2 The Company is not liable for:

  • Damage caused by misuse or failure to follow instructions

  • Wear and tear or damage after delivery

  • Variations in colour, branding, or packaging

  • Losses caused by delay, loss of use, or indirect damage
    10.3 The Company's total liability shall not exceed the purchase price of the Goods in question.

11. Use and Handling of Pool Chemicals

11.1 Customers are responsible for the safe and legal use of chemical products.
11.2 All Goods must be stored and used in accordance with the manufacturer's safety data sheet (SDS) and relevant UK regulations (including COSHH).
11.3 The Company accepts no responsibility for mishandling, unsafe storage, or mixing of incompatible products.

12. General

12.1 The Company may sub-contract any part of its obligations.
12.2 The Customer may not assign or transfer this agreement without written consent.
12.3 If any part of these terms is found unenforceable, the rest shall remain in effect.
12.4 The Company reserves the right to modify these Terms at any time.

13. Force Majeure

The Company shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to: strikes, extreme weather, transport issues, war, pandemics, or shortages of materials.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed under the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
